TERMS OF SERVICE

1. AGREEMENT TO TERMS
By subscribing to or using X Network, LLC (“X Network,” “we,” “our,” or “us”) internet or related services (“Services”), you agree to these Terms of Service (“Terms”). If you do not agree, you must not use our Services.
Scope: These Terms apply to all X Network products and services, including but not limited to X Network Internet, X Fiber, X Voice, Time X, My Crew Log, X Freight, and X POS, as well as any future or ancillary offerings.
2. SERVICE DESCRIPTION
X Network provides internet access and related network services for residential, business, and enterprise users. The availability, speeds, and performance may vary by location, network traffic, and equipment.
3. CUSTOMER RESPONSIBILITIES
- You agree to use the Service for lawful purposes only.
- You are responsible for all activity that occurs under your account or network connection.
- You agree not to engage in any activity that could disrupt or harm our network or other users.
- You must provide accurate billing and contact information and notify us of any changes.
- Contact Information Updates: Customers are responsible for ensuring that all contact, billing, and account information is accurate and up to date. X Network is not responsible for missed notices, invoices, or communications due to outdated or incorrect information. Any penalties, fees, or interruptions resulting from such inaccuracies cannot be waived.
4. PAYMENT AND BILLING
- Billing Cycles: X Network operates two billing cycles each month: one on the 1st and another on the 15th. Your service will be assigned to one of these cycles.
- Net 15 Terms: All invoices are Net 15 and are due within 15 calendar days of the invoice date.
- Late Fees: Payments not received by the due date may incur a late fee of 5%–15% of the past-due amount, as permitted by applicable law.
- All payments are due on the date indicated on your invoice.
- Failure to pay may result in service suspension or disconnection.
- Returned or failed payments may result in additional processing fees.
5. SERVICE INSTALLATION AND EQUIPMENT
- X Network may provide, lease, or sell equipment such as routers or antennas.
- Equipment remains the property of X Network unless purchased outright.
- You agree not to tamper with or relocate service equipment without authorization.
- Damage or loss of leased equipment may incur replacement fees.
- Non-Returned Equipment: Any equipment that is not returned upon request or account termination may result in a charge of at least $499.99 and up to the full replacement value of the actual equipment.
6. ACCEPTABLE USE POLICY
You agree not to use the Service to:
- Engage in hacking, spamming, or illegal downloading.
- Distribute malware, viruses, or any harmful code.
- Interfere with network performance or other customers’ access.
- Violate intellectual property rights or applicable laws.
7. DATA PRIVACY
Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your data.
8. SERVICE AVAILABILITY AND INTERRUPTIONS
While we strive to maintain continuous service, interruptions may occur due to maintenance, network congestion, or circumstances beyond our control. X Network is not liable for such interruptions, though we will make reasonable efforts to restore service promptly.
Limitation: X Network is not responsible for any monetary loss or damages resulting from loss of service and/or outages, whether caused by technical issues, weather events, maintenance, or other factors beyond our control.
9. SPEEDS AND PERFORMANCE
Advertised speeds are maximum theoretical rates and may vary based on device capability, location, weather, network usage, and other technical factors.
10. TERMINATION
Either party may terminate the service with notice as specified in your plan. X Network may terminate or suspend your account immediately if you:
- Violate these Terms or our Acceptable Use Policy.
- Fail to pay outstanding balances.
- Engage in fraud or network abuse.
11. LIMITATION OF LIABILITY
X Network, LLC is not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the Service, including but not limited to loss of data, profits, or business opportunities.
12. INDEMNIFICATION
You agree to indemnify and hold harmless X Network, its employees, and affiliates from any claims, damages, or losses arising from your use of the Service or violation of these Terms.
13. CHANGES TO TERMS
We may update these Terms from time to time. Updated versions will be posted on this page with a new “Effective Date.” Continued use of the Service after changes indicates your acceptance of the revised Terms.

15. SERVICE TERMS AND CONTRACT PERIODS
Most X Network products and services are offered on a no-term (month-to-month) basis. However, in certain situations — such as when a service requires a custom build, construction, installation, or dedicated resources — X Network may establish a fixed-term service agreement.
- Contract terms may be set for 12, 24, 36, or 48 months, depending on the scope of work or promotional terms.
- Any service subject to a contract is legally binding for the full term stated.
- Early termination of a contracted service will result in a pro-rated charge equal to the remaining balance of the contract term.
- X Network reserves the right to recover all applicable installation, build, or setup costs associated with an early cancellation.
By agreeing to service that requires a contract, the customer acknowledges that they have read and accepted these terms and are responsible for all associated fees through the end of the contractual period or until properly terminated per the agreement.
